By accessing or using the products, services, website, mobile applications, or any related offerings provided by Zone Intelligence Inc. ("Zone," "we," "us," or "our"), a Delaware corporation, you agree to be bound by these Terms of Service. If you do not agree, do not use the Services.
2. Description of Services
Zone provides wellness hardware and software designed to support focus and cognitive performance. Zone products are wellness devices and are not medical devices. They are not intended to diagnose, treat, cure, or prevent any disease or medical condition.
3. Eligibility
You must be at least 18 years of age to use the Services. By using the Services, you represent that you meet this requirement.
4. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and complete information when creating an account and to notify us promptly of any unauthorized use.
5. Permitted Use
You may use Zone products and services for personal, non-commercial purposes only. You may not reverse engineer, decompile, or disassemble any Zone hardware or software. All content, features, and functionality of Zone products and services, including but not limited to text, graphics, logos, software, algorithms, and related technology, are owned by Zone Intelligence Inc. and are protected by applicable intellectual property laws. Nothing in these Terms grants you any ownership interest in Zone's intellectual property.
7. Beta Program
If you participate in Zone's beta program, you acknowledge that beta products may be incomplete and provided without warranty of any kind. Zone reserves the right to modify, suspend, or discontinue beta features at any time without notice. Feedback you provide during the beta period may be used by Zone without obligation or compensation to you.
8. Disclaimer of Warranties
The Services are provided "as is" and "as available" without warranties of any kind, either express or implied. Zone does not warrant that the Services will be uninterrupted, error-free, or that any specific outcomes will be achieved through use of the product.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Zone Intelligence Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Zone's total liability shall not exceed the amount you paid for the product or service giving rise to the claim in the twelve months preceding it.
10. Indemnification
You agree to indemnify and hold harmless Zone Intelligence Inc. and its officers, directors, employees, and agents from any claims, damages, or expenses arising out of your use of the Services or your violation of these Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Delaware.
12. Changes to Terms
Zone reserves the right to modify these Terms at any time. We will provide notice of material changes through our website or by email. Continued use of the Services after any modification constitutes acceptance of the updated Terms.
